| We have obtained an order against Florida developer, JB Development of Davenport, LLC, for the return to UK resident clients of deposits totalling $140,800, plus attorneys fees and costs, pre-judgment and postjudgment interest for (1) breach of contract for not building within a material time, and (2) the developer violating the Florida Deceptive and Unfair Trading Practices Act (FDUTPA)in not complying with the registration and disclosure requirements of the Interstate Land Sales Full Disclosure Act (ILSFDA). By bringing the claim through using the FDUTPA, there was a four year limitations period permitted rather than the three years as provided under the ILSFDA. |
