US Civil Litigation : Taking evidence in England for overseas proceedings

The U.K. is party to the 1970 Hague Convention on the Taking of Evidence Abroad in Civil and Commercial Matters and this has been given statutory effect in England.

This enables an overseas Court, by means of a Letter of Request, to ask an English court to appoint an examiner to obtain oral testimony and/or documents from witnesses located in England. This may not be permitted solely for purposes of discovery.

We are available to assist you in litigating your case in the U.S. or U.K. In some instances, we may file pleadings in the courts, engage in discovery, take depositions, appear at telephonic court hearings, etc. Where it is in your interests, we work in conjunction with other local U.S. attorneys.
